Eligibility and CMDE

Who can receive Minnesota EIDBI services?

In plain language: EIDBI is a Minnesota Health Care Program benefit for an eligible person under age 21 who has autism spectrum disorder or a related condition and whose comprehensive multi-disciplinary evaluation (CMDE) establishes medical need. Coverage and service authorization still must be confirmed for the individual.

What a provider should do

Confirm the person’s qualifying health coverage.
Keep the current CMDE and medical-necessity documentation.
Verify authorization before delivering services that require it.

Clinical supervision

What does the 1:16 EIDBI supervision rule mean?

For service authorizations in 2026, the QSP generally must provide at least one hour of clinical supervision for every 16 hours of direct treatment, unless the person’s DHS-7109 identifies an approved clinically necessary alternate plan. The agency also must meet current observation-and-direction requirements.

What a provider should do

Assign a primary QSP and maintain backup coverage.
Track direct-treatment hours against documented supervision.
Record the supervision plan on the current DHS-7109.

Case notes and records

When is an EIDBI case note required?

A provider must create a case note each time an EIDBI service is delivered to the person or legal representative. A stop and restart, including a break or unbillable period, must be documented. Records must support the service that was actually delivered; DHS may recover payment when a billed service is not documented.

What a provider should do

Document each delivered service and each stop-and-restart period.
Keep EIDBI notes separate from unrelated service records.
Use signer identity, date, service details and an auditable correction history.

ITP and forms

Which DHS forms are central to EIDBI planning?

DHS lists DHS-7108 for CMDE medical-necessity summary information and DHS-7109 for the individual treatment plan and progress monitoring. Providers should download the current version from DHS rather than reusing an older saved copy.

What a provider should do

Use DHS-7108 for the CMDE medical-necessity summary.
Use the current DHS-7109 for the ITP and progress monitoring.
Check the DHS forms page for current instructions and translated signature pages.

Provider staffing

Can an EIDBI QSP be an independent contractor?

DHS announced that all QSP EIDBI providers must be employees of the EIDBI agency effective January 1, 2026. The DHS update excludes independent contractors, billing agencies and consultants who do not provide EIDBI services from its employee definition and explains a limited hours threshold.

What a provider should do

Review QSP employment status and agency affiliation.
Keep enrollment and qualification records current.
Use the current DHS provider guidance when making staffing decisions.
